Credit Report Will Be Needed by Bankruptcy

No matter which law
firm or attorney you go to, the law office should asked for your credit
report before filing your bankruptcy. You should be
required to get a current credit report. It is always better to provide one from
all three agencies just to make sure all debts are listed. For many who
are certain they know who their creditors are, a single credit report will
suffice. 
A credit report allows
verification of the debtors you have listed in the questionnaire and to
discover any unknown ones. This is for your protection. It
also shows if your debt has been assigned to a third party so that they
are also notified of your bankruptcy.
Remember if a debt is
not listed on your bankruptcy petition, even if it is debt that can be
discharged in bankruptcy, it will not be discharged if it is not properly
listed. Plus, if a creditor is added after you filed, it will cost
you additional fees to add these creditors, much more than the minimal
fees for
a credit report.
There are even web
sites that offer a free credit report once a year. A link is provided for
you. Please do NOT use a credit card to get the credit report. Either
have someone else use their card or use your bank debit card from your
account. Many people also sign up to monitor their credit scores after
bankruptcy. It is not a bad idea to do so but it is not required.
Make sure you cancel
the paid service within the time period indicated if you do not their
service and just want a free credit report if you are entitled to one.

What is the Fair Credit Reporting Act
(FCRA)
The Fair Credit
Reporting Act (FCRA) requires each of the nationwide consumer reporting
companies — Equifax, Experian, and TransUnion — to provide you with a free
copy of your credit report, at your request, once every 12 months. The
FCRA promotes the accuracy and privacy of information in the files of the
nation’s consumer reporting companies. The Federal Trade Commission (FTC),
the nation’s consumer protection agency, enforces the FCRA with respect to
consumer reporting companies.
A credit report includes information on
where you live, how you pay your bills, and whether you’ve been sued or
arrested, or have filed for bankruptcy. Nationwide consumer reporting
companies sell the information in your report to creditors, insurers,
employers, and other businesses that use it to evaluate your applications
for credit, insurance, employment, or renting a home.
If you have use or had taken action to get
a credit report in the last 12 months you will have to pay for this
service. What is included on a
credit report?
Details about you
such as your financial information and background are contained in your
personal Credit Report. This report is sometimes called a credit file or
a credit history. The Credit Report makes it easy for you to understand
the information that a lender, financial institution, potential employers,
landlord, etc., would be seeing if they review your credit history.
Typical consumer Credit Reports include four types of information such
as:

Personal information can include your name, current and previous
addresses, telephone number, reported variations of your Social Security
number, date of birth and current and previous employers.

Public record information in some states may also include overdue
child support. Bankruptcy information can remain on your Credit Report
up to 10 years; unpaid tax liens can remain for up to 15 years; other
public record information can remain up to seven years. (So not
paying taxes will have a big inpact on your credit scores.)

Credit information includes specific information from each of your
creditors such as the date the account opened, credit limit or loan
amount, balance and monthly payment and payment pattern. The report also
states whether anyone besides you (a joint account holder or cosigner,
for example) is responsible for paying the account. Any active
positive credit information may remain on your report indefinitely,
while most negative information remains up to seven years

The report also lists requests by others who have viewed your credit
history and who has received information from your Credit Report and who
was given your name as allowed by law. According to the Fair Credit
Reporting Act, credit grantors with a permissible purpose may inquire
about your credit information without your prior consent. This section
includes the date of the inquiry and how long the inquiry will remain on
your report.
All credit report
may not show who ordered it. If it is a company the information
about those companies, individuals and institutions who inquired about
your credit history and Credit Score for the purpose of extending a
pre-approved credit offer are included in your report. These inquiries are
not revealed to creditors and do not impact your ability to obtain credit.
Your Credit
Report does not contain data about race, religious preference, medical
history, personal lifestyle, political preference, friends, criminal
record or any other information unrelated to credit. (however let say you
have unpaid medical bills, that may be an indicated you are having a health
problem or if you failed to pay a fine for a criminal matter that may show
up on your credit report.)
